The American Civil Liberties Union (ACLU) of Illinois has been the principal protector of constitutional rights in the state since its founding in 1926. The ACLU, and its affiliated Roger Baldwin Foundation, are non-partisan, non-profit organizations dedicated to protecting the liberties guaranteed by the US Constitution, the state Constitution, and state/federal human rights laws. INSTITUTIONAL REFORM PROJECT - THE PROJECT CONTINUES OUR LONG-TERM WORK TO IMPROVE CONDITIONS FOR CHILDREN UNDER THE CARE OF THE DEPARTMENT OF CHILDREN AND FAMILY SERVICES. DURING THE COURSE OF THE PAST YEAR, THE PROJECT HAS SECURED APPOINTMENT OF A SPECIAL MASTER IN OUR LITIGATION (BH). THE SPECIAL MASTER, A RETIRED FEDERAL MAGISTRATE JUDGE WILL ASSIST IN HELPING TO PUSH EFFORTS AT REFORM AND COMMUNICATIONS FORWARD BETWEEN THE PARTIES. WE FACED AN ACUTE PROBLEM THIS PAST YEAR AS THE STATE OF ILLINOIS MOVED FORWARD WITH A PLAN TO MOVE ALL 17,000 CHILDREN IN THE CARE OF DCFS INTO MANAGED HEALTH CARE SYSTEMS. THIS CHANGE COULD HAVE A PROFOUND- AND NEGATIVE - IMPACT ON OUR CLIENTS. WE HAVE WORKED WITH DCFS AND OTHER STATE AGENCIES TO DELAY THIS PROCESS AND PUT IN PROTECTIONS SO THAT FOSTER PARENTS AND OTHER CARE GIVERS WILL KNOW WHERE TO TAKE THEIR CHILDREN FOR THE HEALTH CARE THEY NEED. THE PROJECT ALSO IS WORKING TO IMPLEMENT CONSENT DECREES IN THREE(3) SEPARATE LAWSUITS DESIGNED TO MOVE HUNDREDS OF PERSONS WITH DEVELOPMENTAL AND PHYSICAL DISABILITIES - AS WELL AS THOSE EXPERIENCING MENTAL ILLNESS - FROM LARGE, INSTITUTIONAL NURSING HOMES INTO THE COMMUNITY CONSISTENT WITH THE AMERICANS WITH DISABILITIES ACT. CORRECTIONS REFORM PROJECT - THE PROJECT IS WORKING TO IMPROVE HEALTH CARE FOR ALL PERSONS IN ILINOIS PRISONS. AFTER YEARS OF LITIGATION, THIS YEAR THE PROJECT SECURED A CONSENT DECREE IN LIPPERT, OUR CHALLENGE TO THE QUALITY OF HEALTH CARE IN ILLINOIS PRISONS. THE DECREE SETS FORTH A SPECIFIC PLAN FOR REFORM WITH A MONITOR TO OVERSEE THAT PROCESS. OVER THE COURSE OF THE LAWSUIT, TWO INDEPENDENT MEDICAL EXPERTS ISSUED SCATHING REPORTS ABOUT THE LACK OF ADEQUATE CARE. IN 2014, THE FIRST EXPERT REPORTED DOZENS OF SYSTEM-WIDE PROBLEMS, INCLUDING LACK OF HEALTH CARE PERSONNEL AND INADEQUATE PHYSICIAN TRAINING. ONE DOCTOR REMOVED A DIABETIC PRISONER FROM INSULIN WHEN THAT PRISONER'S BLOOD SUGAR LEVELS APPEARED "NORMAL." THE RESULTING DAMAGE ENDED WITH THE AMPUTATION OF PATIENT'S FOOT. THE SECOND EXPERT REPORT IN 2018 WAS EVEN MORE DISTURBING. AFTER REVIEWING A SAMPLE OF RECENT DEATHS IN THE PRISON SYSTEM, THE EXPERT FOUND NEARLY HALF OF THOSE DEATHS TO BE PREVENTABLE AND MORE TO BE "POSSIBLY PREVENTABLE.' THE RECORDS WERE SO POOR THAT NO CONCLUSION COULD BE REACHED. THE AGREEMENT FOR REFORM PUTS IN PLACE STRICT REQUIREMENTS FOR PROFESSIONAL CREDENTIALS, STREAMLINING THE SYSTEM FOR CARE, REQUIRING ELECTRONIC MEDICAL RECORDS AND AUDITS OF MORTALITIES. THE PROJECT ALSO IS WORKING TO ENFORCE A SEPARATE CONSENT DECREE IN OUR CHALLENGE TO CONDITIONS IN THE JUVENILE DETENTION SYSTEM - LITIGATION THAT ALREADY HAS LED TO A SIGNIFICANT REDUCTION IN POPULATION IN THAT SYSTEM.
