THE PENNSYLVANIA INSTITUTIONAL LAW PROJECT SEEKS TO DELIVER CIVIL LEGAL SERVICES TO THE INSTITUTIONAL POPULATION OF OUR COMMONWEALTH. DIFFICULTIES WITH ACCESS AND THE UNIQUE NATURE OF INSTITUTIONAL LEGAL ISSUES REQUIRE A SPECIALIZED METHOD OF DELIVERING SUCH SERVICES.THE PROJECT WAS CREATED AND DESIGNED TO MEET THE NEEDS OF LOW INCOME RESIDENTS OF OUR PRISONS, JAILS, STATE HOSPITALS, AND STATECENTERS.THE GOAL OF THE INSTITUTIONAL LAW PROJECT IS TO ENSURE EQUAL ACCESS TO JUSTICE FOR INDIGENT INSTITUTIONALIZED PERSONS. WE ARE A NON-PROFIT ORGANIZATION ADMINISTERED BY THE PA LEGAL AID NETWORK, INC.

OUR GOALS CONTINUE TO BE PROVIDING COMPETENT PROFESSIONAL REPRESENTATION TO AN EXTREMELY VULNERABLE POPULATION OF INSTITUTIONALIZED PERSONS. WE HAD ANOTHER SUCCESSFUL YEAR LITIGATING CIVIL RIGHTS CLAIMS ON BEHALF OF INMATES. THE CHIMENTI CASE SETTLED WHICH WILL ALLOW 6,000 INMATES IN THE PA DCO TO GET THE LATEST TREATMENT AVAILABLE FOR HEPATITIS C. THE TREATMENT WILL INCLUDE ALL PERSONS WITH HEPATITIS C IN THE SYSTEM OVER A THREE YEAR PERIOD. NEW MIRACLE DRUGS HAVE A 99% SUCCESS RATE FOR THIS CHRONIC DISEASE. WE PARTNERED WITH LAW FIRM OF KAIRYS AND RUDOVSKY. WE PARTNERED WITH THE ACLU OF PA., SCHNADER HARRISON AND SEGAL, THE ABOLITIONIST SOCIETY, AND THE ARMISTEAD PROJECT IN A SUCCESSFUL CHALLENGE TO A NEW LEGAL MAIL POLICY IN THE PA. DOC., PILP ET AL V. PA DOC. WE CONTENDED THAT THEIR NEW POLICY, CREATED TO STEM THE FLOW OF DRUGS INTO INSTITUTIONS FAILED TO PRESERVE CONFIDENTIALLY OF LEGAL MAIL. A FAVORABLE SETTLEMENT WAS REACHED ONE DAY AFTER THE TRIAL STARTED. THE SYSTEM OF PHOTOCOPYING LEGAL MAIL CEASED AND WAS REPLACED WITH A SYSTEM SIMILAR TO THEIR OLD SYSTEM WITH THE INTRODUCTION OF A WEEKLY CODE NUMBER TO PREVENT FRAUD. WE SETTLED TWO SEXUAL ASSAULT CASES BUCANO AND SARVEY, WERE FEMALE INMATES WERE COERCED INTO SEXUAL RELATIONSHIPS WITH MALE CORRECTIONAL; OFFICERS. THE HIDALGO CASE ESTABLISHED NEW RELIGIOUS FREEDOMS FOR NATIVE AMERICAN INMATES. THE CASE OF I.Z. INVOLVED GRATER PROTECTIONS FOR TRANSSEXUAL.SEVERAL IMPORTANT CASES ARE ONGOING. WORK CONTINUES OF THE E.D. CASE INVOLVING A SEXUAL ASSAULT OF OUR CLIENT IN THE BERKS COUNTY FAMILY SHELTER FOR ICE DETAINEES. THE RICHARDSON AND MCCREARY CLASS ACTIONS CHALLENGE POLICIES AND PRACTICES AT THE SPECIAL MANAGEMENT UNIT AT THE LEWISBURG FEDERAL PENITENTIARY. RICHARDSON INVOLVES THE EXCESS USE OF SHACKLES AND MCCRAY INVOLVES LACK OF TREATMENT FOR THE MENTALLY ILL. WE ARE PARTNERING WITH THE DECHERT FIRM AND THE LAWYERS COMMITTEE FOR CIVIL RIGHTS IN WASHINGTON DC AND THE LATHAM WATKINS FIRM OF WASHINGTON DC IN THOSE CASES. WE ARE WORKING WITH THE ACLU OF PA. IN A CHALLENGE TO THE CONDITIONS OF CONFINEMENT AT THE FAYETTE COUNTY JAIL. WE ARE WORKING WITH THE WOMEN'S LAW PROJECT [WLP] ON A SEX DISCRIMINATION CHALLENGE AT THE BERKS COUNTY JAIL. WLP IS IN AN ADVISORY CAPACITY. TWO INJUNCTIONS WERE OBTAINED ALLOWING FEMALE TRUSTY AND WORK RELEASE INMATE'S EQUAL ACCESS TO REENTRY SERVICES PREVIOUSLY AVAILABLE ONLY TO MALE INMATES. CLASS CERTIFICATION WAS GRANTED HOWEVER DEFENDANTS HAVE APPEALED ALL THREE RULINGS. EMERGING ISSUES EVOLVE IN THE CONSTANTLY CHANGING CRIMINAL JUSTICE ENVIRONMENT. OVERCROWDING IS ON THE WANE ESPECIALLY IN PHILADELPHIA AS THE EVILS OF MASS INCARCERATION AND THE FAILED WAR OF DRUGS GAIN ACCEPTANCE WHILE IMMIGRATION AND SEXUAL ABUSE SEEM TO BE GREATER PROBLEMS IN PENNSYLVANIA. HARVEY ROBINSON WON A JURY VERDICT OF $10,000 AS HE WAS ABLY REPRESENTED BY ALEXANDER MORGAN-KURTZ AND MATTHEW FELDMAN. THE TRIAL WAS HELKD BEFORE JUDGE KELLY IN THE FEDERAL COURT IN PITTSBURGH. DEFENDANTS HAVE AGREED TO PAY ATTORNEY FEES OF $15,000 PLUS COSTS.
